1.              ABOUT THESE TERMS AND CONDITIONS

1.1            These Terms of Service (as may be amended from time to time) set out the terms on which we provide all our services to you (whether directly or indirectly) including without limitation the basis on which we act as agent on behalf of any Partner. By accessing, browsing, and using any website maintained by us including without limitation the website at www.winetourism.com and our social networking pages (together the “Website”) or communicating with us either by telephone, electronically and/or by completing a reservation, you acknowledge and agree to be bound by these Terms of Service.

1.2            WineTourism.com may at any time without notice modify these Terms of Service. We will notify you of any changes to these terms either by emailing you (at the email address notified by you to us on the website) or via posting a notice on the website.

1.3            By continuing to use the Website after changes to these Terms of Service are made and notified to you, you agree to be bound by such changes.

1.4            You can review the most current version of our Terms of Service at any time by clicking on the “Terms of Service” link located on the Website footer. The most current version displayed on that page will supersede all previous versions.

2.               PRICING AND PAYMENT TERMS

2.1            COMMISSION ON BOOKED EXPERIENCES

2.1.1 WineTourism.com takes a transaction-based fee of 10% of the transaction value, or minimum €2 per person, whatever is the larger of the two calculated fees. The winery will receive a net payment from WineTourism.com equal to the listed experience price minus the transaction fee.

Example 1:

1 person books 1 experience with price €10

Fee = €2 (€2 per person)

Example 2:

2 persons book 1 experience with price €10 per person (€20 for 2 persons in total)

Fee = €2 per person x 2 persons = €4 in total

Example 3:

1 person books 1 experience with price €30 

Fee = €3 (€30 x 10%)

Example 4:

2 persons book 1 experience with price €30 per person (€60 for 2 persons in total)

Fee = €3 (€30 per person x 10%) x 2 persons = €6 in total

2.1.2            WineTourism.com uses a Stripe-powered payment solution to guarantee a secure and SSL (Secure Socket Layer) encrypted payment transaction for the guest.

2.1.3            Payment will be made to the winery on the time and date of the booked experience.

2.2 PAYMENT TO THE EXPERIENCE PROVIDER

2.2.1 Payment is made by the visitor online via Stripe and retained by WineTourism.com until the experience has been successfully provided to the visitor, subject to cancellation policy and refund terms (see below). Upon conclusion of the experience, WineTourism.com will ask the winery to send an invoice with the listed price of the experience minus the relevant commission (10% or minimum €2 per person). Once the invoice has been received payment will be made via a bank transfer from WineTourism.com to the experience provider according to the account details provided in the user account of the experience provider. The experience provider will receive an email receipt of the transaction from Stripe.

2.3 ACCOMMODATION BOOKING AND PAYMENT TRANSACTION

2.3.1

3.               CANCELLATION AND REFUND TERMS

3.1            The guest reserves the right to cancel the booking up to 48 hours ahead of the starting time of the booked experience. In this case, the guest will be reimbursed the full cost of their experience to the credit card used to make the original booking. Similarly, a guest can modify the content of the booking (change experience, date, number of people, etc.) up to 48 hours ahead of the starting time of the booked experience. The modified booking will in practice be treated like a new booking, meaning it will be subject to availability. If the modified booking is not available at the winery, the guest will be notified, and can choose to keep the original booking, or to cancel the booking entirely, in which case the total cost of the experience will be reimbursed. If a cancellation is made less than 48 hours before the starting time of the booked experience, the guest is not entitled to a reimbursement of the costs for the booking.

3.2            In exceptional cases, a winery may need to cancel a booking made by the guest due to weather, sickness, shortage of staff or other reasons. In these cases, the WineTourism.com team will coordinate with the winery and will ask the visitor if they are willing to accept another time for a visit to the winery. Should the guest choose not to accept this new experience, the guest will be reimbursed for the price of the original booking. 

4.               CONTENT POLICY AND UPDATES TO ACCOUNTS
4.1            Wineries, local wine guides and other actors ("Partners") who collaborate on the website are responsible for creating and updating information so it is accurate and correct. This is essential for a great visitor experience, so that the information the visitor sees on the website reflects the Partners' experiences, prices and availability to the fullest extent possible


4.2            Partners are responsible for ensuring that they have the necessary rights and consent to use all text, images and other content they upload or create on the website.


4.3            Partners are responsible for uploading, creating, editing and updating content on their account. Should the Partner need it, we are more than happy to assist in the content creation process. In this case, we will in dialogue with the Partner ensure that any material used or created adheres to the necessary legal rights, ownership and consent, as stated above.


4.4            Our goal at WineTourism.com is to successfully showcase your wine experiences to a global online audience, a key element in this success is making sure the content presented is optimised to rank well and be highly visible in search engines and on social media. To this end, the WineTourism.com team reserves the right to adjust content so it is aligned with our digital marketing practices and general language quality. We will always to the largest extent possible preserve the original text of the Partner, and the uniqueness of the experience. The Partner will always be asked to revise the content posted through their account, and always retain the possibility to unpublish content should they not be in agreement.


4.5            Content that is in violation of WineTourism.com's content policy will be removed from the website. Content that is not allowed - unless otherwise agreed to with WineTourism.com - includes:


  • Content created to advertise or commercialise a product, service or brand
  • Spam content that is disruptive and irrelevant to the website content
  • Content endorsing illegal activity
  • Content that is threatening, harmful or discriminatory 
  • Content pretending to a false identity that is not the user that posted the content
  • Content that violates laws concerning intellectual property rights and privacy rights
  • Confidential information or information belonging to private persons

5. TERMS AND CONDITIONS FOR WINE SALES ON WINETOURISM.COM

5.1 WineTourism.com allows wineries to display wine products on the website. Visitors to the website can view the wine products and request an order. WineTourism.com collects the visitor's order request - along with contact details - and forwards this information to the wineries via email.

5.2 Upon receiving the forwarded request, the winery is obliged to answer the customer. The winery can choose not to accept the order request for whatever reason. If the winery chooses to accept the order request, they will quote a total price for the purchase that includes taxes, shipping and other handling fees. The customer then chooses to accept or reject this quote.

5.3 If the customer accepts the quote, the winery will be responsible for the sales, shipping and subsequent communication with you, the customer, to realise the transaction. WineTourism.com does not take responsibility for the transaction after customer details have been forwarded to the winery. With that said, we are of course available for contact to the customer or winery, should they have any questions or concerns.

5.4 WineTourism.com provides this service free of charge, there is no commission, subscription costs or other fees associated with displaying wine products on the website.
